Wolfgang Halbig's Appeal verses Connecticut's Freedom of Information Commission has been dismissed because Wolfgang Halbig failed to file a simple appearance.

Issue 1 Dash Cams: - The Commission Ordered Connecticut State Police to release the Dash Cams.  Connecticut State Police appealed the decision.

Issue 2: Original copies of Newtown Police Officer Statements -  The Commission ordered that these were witness statements and not subject to release.   Wolfgang Halbig appealed that decision.

Connecticut Attorney L. Kay Wilson represented Wolfgang Halbig, despite the fact he was publicly degrading her.  Wolfgang Halbig promised his donors he would do what it takes to get the Dash Cams.

Allegedly, L. Kay Wilson finally tired of the public thrashing Wolfgang gave her, (although she never tired of her disgusting beliefs about Sandy Hook manifested by here disgusting treatment of Newtown townies and officials) and she withdrew from representation.

The Judge gave Wolfgang until July 31 to appear. When Wolfgang failed to file his appearance, his case was closed.

Wolfgang never filed an appearance and the appeal is DISMISSED as a nonsuit.

Wolfgang Halbig DENIED Connecticut FOIA without a hearing AGAIN

"[Halbig] has filed many requests with agencies in the Town of Newtown ... related to the tragedy which occurred there on December 14, 2012 which the complainant has publicly stated didn't happen.  [His] frequent derisive insulting emails to the town and this commission are tantamount to harassment."  - Connecticut FOI Commission

Halbig was once again seeking the identities and documents of little school children from their school. The Commission will not even hear his ridiculous and disgusting arguments.

Wolfgang Halbig has once again been denied Connecticut Freedom of Information (FOI) hearing by the Connecticut Freedom of Information Commission based in part on their decision that Halbig's repeated insulting and derisive emails are tantamount to harassment and that he is a repeat offender.

This is the third and fourth Halbig cases the Commission decided without granting Halbig a hearing. The first two were in November, 2016:

The final determination will come today, 2-22-17, at the meeting of the full commission.

The Executive Director of the Commission decided not schedule a hearing on  Halbig's repeat requests for documents related to the 2013 Super Bowl trip by the Sandy Hook Choir.

Hoaxers, in general, absurdly believe the children who sang at the Super Bowl are the same children who died (aged 6 plus years) during the 2012 Sandy Hook massacre.  Halbig seeks a number of documents, such as "children permission slips" that would not be obtainable even if they did exist. Obviously, children's school records are not subject to Freedom of Information.  Newtown has repeatedly told Halbig they do not have the documents.

Imagine if internet weirdos could simply FOI your child's school records.

The vote, expected today, is that the Commission will not hear Halbig's hoaxer nonsense in regards to this issue.

One example of Wolfgang Halbig's hoaxer nonsense on this is issue is his claim that the NFL "placed a gag order" on the children.  Halbig tells this lie to encourage people to donate to him; however the statement is 100% false.  Halbig has no evidence of this "Gag Order" and in fact, when Sandy Hook Facts offered $5,000 to Halbig to produce a "Gag Order", Halbig failed.  Recently, Halbig has been saying that the children must be dead or kidnapped.

Appeals filed in Wolfgang Halbig Freedom of Information Dash Cam Case

Both parties have filed an appeal of the Freedom of Information Commission ruling in Wolfgang Halbig versus Connecticut State Police.

Halbig was requesting seized Newtown Police Sandy Hook dash cams. The Commission found partially in his favor, ordering those released.  Halbig is seeking four dash cams; two of which he already received in a timely fashion from Newtown Police (Seabrook and Sinko).

Halbig was also requesting Newtown Police Officer Sandy Hook statements. The final report only released summaries of these statements because the  State Police maintain the position that these are exempt from disclosure based on the fact they  are "witness statements".

The appeal by the Connecticut State Police, filed 12-14-16, asks for a stay on the order to release the dash cams and a ruling overturning the order to release the Dash Cams.

Kay Wilson stays on board

It is note worthy that L. Kay Wilson is still representing Wolfgang even though Wolfgang has been degrading and disparaging her lately; in one recent interview saying "she's compromised" and that he "did not trust her".   I suspect that Wolfgang must be paying very well since Kay Wilson continues to represent Halbig, even though he humiliates her publicly.

Jonathan Reich is currently remanded and will remain in jail until an extradition hearing on December 19, 2016.

Reich still shows as represented by Legal Aid, so apparently Sandy Hook Justice has not ponied up the dough they collected to help "Jonathan Reich bring down Connecticut" with his court battle.

Wolfgang Halbig's attorney left the case and Halbig is proceeding without an attorney.  The saying "A person who represents themselves has a fool for a client" is no truer than it is here. Halbig filed an untimely Motion to Dismiss, which was effectively a demurer and filed after the answer.  Lenny's attorney responded asking to strike the motion and award attorney fees for the frivolous filing.

This is a no-brainer slam dunk for Attorney Fees for Lenny Pozner.

They have attempted to obtain the school records of the Sandy Hook Choir; the children who sang at the Super Bowl.

The wild-eyed duo have filed least four FOIA appeals  related to the identity of the school choir; not to mention countless FOIA requests through the Newtown School District itself.

Since most normal people can't really fathom what it's like to target the school records of another parent's child, this is a sample of Halbig going after "permission slips and names" of the young, innocent children.

Luckily for Newtown's children, school records are exempt from FOIA and Newtown's Town Attorney, Monte Frank has been vigilant in ensuring the safety of the children's identities from the hoaxer hoard.  He stops Halbig at every turn!

 One can only imagine the videos Halbig's mentally ill followers would create if they got the children's identities; not to mention the terrorizing of the families that would occur.

Connecticut law is very clear; yet L. Kay Wilson and Wolfgang Halbig persist with their obsessive requests:

As is well documented, hoaxers believe these children are the "actors" who "played" the deceased children. As a result, online gangs of hoaxers plot against and relentlessly these children and their families.  Recently, one of Wolfgang's followers was calling the work of one of the mothers of the children!

  What makes the hoaxer so dangerous in comparison to other Conspiracy Theorists is their willingness to terrorize small children over their weird, radical, conspiratorial belief system.  Sandy Hook Hoax is one of the few cult like belief systems where targeting small children is the norm.

Wolfgang Halbig and Connecticut attorney L. Kay Wilson have led the charge to publicly "expose" the little children to the hoaxer community going so far as to disgracefully file the "Freedom of Information Act requests".

Recently the Freedom of Information Commission met to discuss whether to hear Wolfgang's disgraceful and unlawful requests.  While a ruling has not been formally published, a well placed source confirms the FOI Board decided Halbig was not even entitled to a hearing on such a ridiculous and mean spirited and unlawful requests.  Bravo!

The Commission meets to discuss the proposed ruling on 9-28-16.  While attendance by the parties is not required, Halbig and his attorney, tL. Kay Wilson typically attend.

Kay Wilson and Wolfgang Halbig appeared before FOIA Commission's Hearing Officer Perpetua to once again argue versus the Connecticut State Police for the release of Dash Cams and Reports not released with the Sandy Hook Final Report. The second hearing of FIC 2015-786. The first hearing was heard Feb. 18.

Prior to this hearing, Mr. Perpetua had all but made it clear he would rule in Halbig's favor, so it appears L. Kay Wilson and Halbig decided they would take the opportunity to put their pursuit of argument in this case on hold and put on a little show.

Halbig delivers a fantastic performance!

Halbig and Wilson began their Best in Show with props.  Halbig was all mic'd up by Mert. Halbig prominently displayed one of his famous rubber duckies on the desk in front of him,  fiddling with his duckie often, and often facing it directly towards Mert Melfa's camera.

For another prop, Halbig appeared to be demonstrating his contempt for Sandy Hook School victims by blowing his nose on a green shirt. Eye roll on that prop.

It seems very similar to something like this, although we did not get a clear view of the logo.

It's 2014 again

Halbig and Wilson decided that, instead of focusing on the matter at hand, they would  pretend to attempt a backdoor re-litigation of  their failed 2014's case versus Newtown.  

Halbig previously appealed the Newtown decision. Halbig voluntarily dismissed his own appeal October 2015 when Kay Wilson withdrew the action. That decision is final, by their own hand.

Personally, I do not believe Wilson or Halbig believed this discussion would be allowed by Hearing Officer Perpetua.  The Newtown case was two years ago and Newtown was not even present. Perpetua has demonstrated he is a no-nonsense hearing officer.  It's obvious that it would not be allowed.

As would be expected, the Commission did not allow the duo to discuss the 2014 Newtown case. The attempt set the stage for Halbig's planned big finale.

Legal Updates: Wolfgang's hearing, Wolfgang's newest WHOPPER, and William Shanley's Appeal gets dismissed.

Wolfgang Halbig's FOI hearing has been reopened. There are a couple of stories in the works on that hearing as that hearing featured several WHOPPERS told by Wolfgang Halbig and his Attorney L. Kay Wilson.  It's important we document these WHOPPERS, as these individuals use these false statements to bolster Halbig's fundraising activities.  Those funds are then used to squash the free speech of bloggers covering the Sandy Hook hoaxer story.

Wolfgang is seeking Dash Cams and signed Newtown officer statements related to 12-14-12. Connecticut State Police has refused to release these documents claiming they are exempt.

Sandy Hook Facts is on record as to supporting the merits of some of Halbig's arguments on these requests.  These two requests are intelligible and request documents that arguably should be released; unlike most of Halbig's other requests.  In fact, Sandy Hook Facts has requested many of the same documents as Halbig requested here, and been similarly denied access; so it would be hippocritical not to at least give a nod to the merits of Halbig's claim.

Sandy Hook Facts believes these requests could be handled in a honest and forthright manner and the merits the valid transparency .  False claims, such as L. Kay Wilson's claim "We have not received Sinko's Dash Cam", need not be made.

Freedom of Information Commission (FOIC) - Connecticut

On February 18, 2016 Wolfgang Halbig appealed to the FOIC for the release of documents related to the Sandy Hook Shooting.  The commission has published it's proposed decision.

As an aside, Wolfgang Halbig and his crew are claiming that the Hearing Officer only had 30 days to issue a ruling. As with nearly everything Halbig and his agents state, the claim is false and simply made to beef up donations. Bottom Line
The bottom line of the decision:
 If the Appeals court overturns the Altimari decision, Wolfgang might get the Dash Cams.  FOIC ruled against him on the officer affidavits.

Wolfgang's matter will be heard July 27, 2016 at 2:00 pm in Hartford. Newtown schools would do well to be ready since Wolfgang is again promising to bring a film crew and hoaxers are simply unpredictable.

Dash Cams and Police Witness Statements

Wolfgang's appeal concerned two sets of items: Dash cams and sworn police statements. 

First request: Dash cams from the vehicles of Newtown Officers Bahamonde, Chapman, and Seabrook, and Sinko.  

Newtown refuses to release their copies of the Chapman and Bahamonde videos claiming they would expose minor's identities and are thus exempt.  Seabrook and Sinko's Dash Cams were previously released.  CSP is in possession of copies of all the videos, having seized them as part of the Sandy Hook investigation.  Wolfgang attempted to obtain those seized copies.  CSP refused claiming they were seized evidence and thus exempt.  CSP's claim is the same claim they made in the Altimari  case (discussed below).

Second request:  the "official police reports and affadvits of Chief Kehoe, Captain Rios, Lt. Sinko,  Lt. Robinson, and Lt Vangehele" (sic).

 In the final report, the CSP provided a summary of officer statements and redacted the actual sworn statements themselves claiming they were exempt from release as witness statements.  Wolfgang requested the full statements.

The Ruling

Dash Cams - Not surprisingly, the commissioner ruled as he indicated at the hearing itself: the dash cams must be released.  The ruling was stayed pending the Altimari appeal decision since the items requested by Halbig were similarly seized and in the possession of CSP.

In summary, if the Appeals Court overturns the Superior Court decision and orders the Sandy Hook shooter's home documents released from Connecticut State Police (CSP) to the Hartford Courant, Wolfgang might get his dash cams. If the appeals process upholds the Superior Court rulings, Wolfgang will not get the Dash Cams.

I will point out that there is a potential "Ace in the hole" that has not been played by Connecticut that could come into play.  Although Newtown did not make the objection at the hearing, at some point they could attempt to intervene based on safety of the minors (as to the Chapman and Bahamonde videos) and the exemption that makes releasing a minor's identity exempt.  This card was not played by Connecticut since CSP's attorney claimed never to have watched the videos.

Officer Statements 

CSP would not release the statements claiming that witness statements are exempt.  The commissioner agreed, ruling that the statements of Newtown Officers taken by Connecticut State Police were witness statements and therefore not subject to disclosure.

While SHF agrees officers statements are witness statements, Sandy Hook Facts disagrees with this ruling at a base personal level.  This appears to be a loop hole in the law.  That said,  I do not believe hoaxers should be given any more information to abuse Newtown residents or to line Wolfgang's pockets with cash.  There has already been more information formally released about the Sandy Hook shooting than any other mass shooting in history.

Empty Handed

At the end of the day, Wolfgang will once again walk away empty handed.

Wilson has has once again teamed with Halbig to file an appeal with the FOIA commission and this time she is not limiting herself to government officials or police officers. This time the number one target on their attack list is Newtown school children.

The appeal is for a demand to the Newtown Public Schools that states that Halbig and Wilson want:

#1: Copies of the 26 children's names and parental field trip permission forms".  (of the Sandy Hook Chorus).

Newtown obviously refused their disgusting request and Halbig and Wilson, desperate to go after these children's identities have appealed to the Commission.  Wilson and Halbig are acting as if children's personal school records are public records! Of course they aren't!

No date has been set for the hearing.

Wilson's request is outside the clearly written law thus showing hoaxer desperation.

Court Rules against releasing Sandy Hook Shooter Records - Courant FOIA

New Britain, CT: Judge Carl Schuman  has ruled against the Connecticut Freedom of Information Commission,  Dave Altimari, and the Hartford Courant, denying the release of  copies of the records seized from the Lanza Residence currently in the possession of the Connecticut State Police.  The Connecticut State Police had contended the items were exempt as seized property.

The Connecticut Freedom of Information Commission had ruled that copies of the information held by the State Police was public record, ordering the Connecticut State Police to release copies of the records.  The court ruling reversed the Connecticut Freedom of Information's ruling.

Ultimately, the court ruled that statutes in Connecticut law, "Title 54 act as a shield from public disclosure of all seized property not used in criminal prosecution."

It is anticipated that the decision will be appealed all the way to the Supreme Court.

Sandy Hook Hoax Attorney L Kay Wilson Announces Wolfgang Halbig FOIA Withdrawn

It was apparent Kay Wilson was slipping farther into the Cult of Conspiracy when she appeared, independent of Wolfgang Halbig on James Fetzer's Real Deal Episode 67 and discussed her own views.  Wilson announced "I no longer believe in the official [Sandy Hook] narrative."

Sandy Hook Hoax supporter and Connecticut Attorney L Kay Wilson announced to her supporters "Sandy Hook Hoax" that the scheduled FOIA Hearing for March 17, 2016 was withdrawn.

It is curious that Wolfgang Halbig has apparently stopped making his announcements,  dispatching his attorney, L. Kay Wilson to the menial task of bringing Tony Mead into the loop.

L Kay Wilson promised her friends at Sandy Hook Hoax Group a "slew" of upcoming hearings in the near future.

L Kay Wilson is starting to become a more prominent public figure within the Hoaxer community. She has made appearances on InfoWars and James Fetzer's program, among other public discussions.

Kay Wilson is also beginning to act more and more like a hoaxer conspiracy theorist.

Did Kay Wilson issue a harassing subpoena to Shannon Hicks?

L Kay Wilson caused controversy during the February, 2016 FOIA hearing when she issued subpoena to Newtown Bee Reporter Shannon Hicks.

As most know, Shannon Hicks took the iconic photographs of the evacuation of Sandy Hook School after the shooting on 12-14-12.

The FOIA case for which Kay Wilson issued subpoena involved Halbig's requests for records from the Connecticut State Police.   A review of the case, including video of the hearing can be viewed here:

Kay Wilson's friends at Sandy Hook Hoax Group were overjoyed that Shannon Hicks would be issued a subpoena.  Sandy Hook Hoax Group takes pleasure in any harassment of Newtown residents, as has been well documented.

The question that puzzled an attorney who viewed the subpoena issue was: "What relevant information could Shannon Hicks possibly provide the FOIA Commission concerning records in possession of Connecticut State Police?"

When the FOI hearing officer asked L Kay Wilson to summarize her anticipated  case in chief, Wilson made no mention of calling Shannon Hicks.  So why did Kay Wilson choose to cost the reporter and the Newtown Bee money and time by forcing appearance?

Since there seems to be no relevant information Hicks could have provided concerning Connecticut State Police records and since Wilson did not call Hicks to testify, some have speculated the subpoena was issued just to bully or harasss  the reporter.  In other words, Wilson may have issued the subpoena out of pure meanness towards one of those most profoundly affected by the shooting; and thus, Wilson may have violated ethical and moral conduct.

Shannon Hicks did appear pursuant to Kay Wilson's ludicrous demand, along with the Newspaper's attorney, causing the newspaper significant monetary damages.  It would seem fair Kay Wilson and Wolfgang Halbig owe compensation  for those damages.

James Fetzer is well known as a hard core antisemitic conspiracy theorist who once pushed the idea that Mossad Death Squads attacked the Sandy Hook School and who teamed up with Wolfgang Halbig and James Tracy to co-write "Nobody Died at Sandy Hook". The book was so vile and full of lies, Amazon refused to soil their shelves by selling it.

Kay Wilson also referred to believing the Sandy Hook "narrative" as "drinking the Kool-Aid".

Her apparent contempt for the victims and families in Newtown could explain why she needlessly issued subpoena to Shannon Hicks.

These actions are right in line with Kay Wilson's failed attempt to submit hoaxer modified evidence to the CT FOI Connecticut Commission by folding it, to hide the modified portion.  Attorney Monte Frank objected stating "It's clearly not authentic."

Hearing Set in the Dave Altimari's appeal of Adam Lanza FOIA Documents

The Superior Court in New Britain, Connecticut has set a hearing in the Commissioner, DESPEE (Connecticut State Police - "CSP") vs Freedom of Information Commission case.   This is the "Dave Altimari/Hartford Courant Adam Lanza documents FOIA appeal.

Dave Altimari submitted FOIA documents seized from the Yogananda Residence related to the Sandy Hook shooter.

The hearing is set for March 15 at 10:00 am.

The Hartford Courant submitted Freedom of Information Requests for 35 documents related to the Sandy Hook shooter.  These documents include drawings, the "Big Book of Granny", class photo from Sandy Hook Elementary School from 2002-2004, "Lovebound" a play about a love affair between a 10 year old boy and a 30 year old man, and the infamous "Spreadsheet of Mass Murders".

The FOIA Commission ruled in favor of Altimari; ordering the CSP to release copies of all of the documents.

CSP appealed, arguing that seized evidence is strictly confidential because it is seized evidence in a case and it "might be returned"; although CSP does not dispute they maintain a copy of the records in their files, even if the originals were returned.

FOIA Commission Attorney Victor Perpetua

Attorney Victor Perpetua, the hearing officer from the recent Halbig hearings, submitted the Commission's legal brief in support of disclosure  to Altimari.  An impressive read that carries the weight of a sledgehammer.  Attorney Perpetua argues the powers of the Commission to decide these matters, the limited over site responsibility of the courts, and the fact that the records are obviously Public Records under Connecticut Law since they are nonexempt records being maintained by a public agency.   Perpetua also points out the weak case put forth by CSP; thus CSP cannot now make additional sweeping arguments not originally put forth at the hearing.

The document is an impressive argument in favor of the public's right to information.

As with the Halbig case, CSP Attorney Christine Plourde again stated she never viewed the evidence for which she is the representative.   Plourde's nonsense hurt the CSP vs Halbig because had Plourde viewed the videos, she would know that minors are on the videos the FOIA Commission will surely order released.  Thus, she missed using a codified exception.

Here, Plourde's failure does not matter so much since we are talking about the shooter; the shooter is not a minor and the shooter should be, figuratively speaking, hung from a hook in town square, for all to see.  

Sandy Hook Facts has covered this case extensively because SHF also FOI'd the same documents as Dave Altimari (among many other documents), separately, and was also denied by CSP.  Lacking resources to pursue the appeal; Sandy Hook Facts is very interested in this appeal and offers it's full support to Dave Altimari.  If Altamari wins his appeal, SHF will submit renewed FOIA requests.

Wolfgang Halbig FOIA tells a WHOPPER while under oath

Unlike the last FOIA Hearing, the commission kept strict control of Wolfgang Halbig, keeping him from throwing fits or pontificating about nonsense; however, Wolfgang, with the few short sentences he was allowed to spew, still found a way to work in a Whopper.

Whopper: Wolfgang Halbig, under oath, under penalty of perjury, before God, claimed to have 20 years of Law Enforcement Experience.

Truth: Wolfgang Halbig does not have 20 years of Law Enforcement Experience.  He was a State Trooper for about a year and possibly a part time Customs worker for about a year.

Wolfgang Halbig was therefore NOT truthful under oath.
